Harassment/ Sexual Harassment

An act of harassment, sexual or otherwise, occurs in the context of the AGG when undesired behaviours with a discriminatory characteristic violate the dignity of a person and create an atmosphere of intimidation, hostility, humiliation or indignity.

  • Unjustifiable inspection of person in a department store or on public transportation
  • Patronizing or insulting behaviour (for example, addressing someone by his or her first name) from sales or service personnel.
  • Repeated sending of racist jokes by colleagues via the internet.
  • Mobbing with a discriminatory aspect.

An act of harassment within the parameters of the AGG can, under certain conditions, can be criminally prosecuted as insult or injury according to §185 of the criminal code.
